Defendants shall be punished by imprisonment for not more than two months.

Punishment of the crime

Defendant

A on December 6, 2012, who was sentenced to imprisonment of one year and ten months with prison labor at the Suwon District Court on December 6, 2012 and became final and conclusive on December 14, 2012, and Defendant B, who was sentenced to imprisonment of two years and four months with prison labor at the Suwon District Court on December 6, 2012 and was sentenced on December 7, 2012, is serving in prison in each Seoul Southern Prison.

1. On April 9, 2012, the Defendants: (a) provided C’s resident registration number known of the trade name located in the Southern-gu Incheon Metropolitan City through the Internet to the service provider with a false identification card; (b) entered the name “C”, resident registration number “D”, and issuer “the head of the Dong-gu Busan Metropolitan City,” and issued to the Defendants by creating a resident registration certificate accompanied by a photograph of the deceased.

As a result, the Defendants forged C’s resident registration certificate of the head of the same Gu, a public document, for the purpose of exercising in collusion with a person who is not registered.

2. On April 9, 2012, the Defendants sent a copy of the forged resident registration certificate to an employee of “E”, a mobile phone agent who is unaware of the circumstances, by facsimile in order to open a mobile phone using a forged resident registration certificate copy as referred to in paragraph (1) at a scarb where the trade name in the Southern-gu Incheon Metropolitan City is unknown.

As a result, the Defendants conspired to exercise their resident registration certificates issued by the head of the same Gu.

3. On April 9, 2012, the Defendants: (a) entered the name of the subscriber “C”, resident registration number D, etc. in the name of C in order to open a mobile phone in the name of C at a scam room where the trade name in the Southern-gu Incheon Metropolitan City is unknown; and (b) arbitrarily drafted an application for joining the mobile phone in the name of C signed in the signature column.

As a result, the Defendants conspired to exercise their rights and duties.
