그럼에도 피고인과 B, E, F, G, H, I은 2017. 5. 23. 경부터 2018. 3. 20. 경까지( 피고인 G는 2018. 2. 12. 경부터 2018. 3. 20. 경까지) 위 ‘D 게임 랜드 ’에 특정 배경 화면이 나타나면 연타로 100만 원까지 점수를 획득할 수 있는 ‘ 칙칙폭폭 IC’ 등의 게임기 60대를 설치하고 불특정 다수의 손님들의 이용에 제공하면서 속칭 ‘ 똑딱이’ 로 불리는 자동게임 진행장치를 이용하여 이용자의 능력과 무관하게 획득한 점수를 IC 카드에 입력해 주어, 손님들이 위 IC 카드를 게임 장 밖에 대기하고 있던 피고인 G 등 환전상에게 전달하면 위 환전상이 IC 카드에 저장된 점수( 속칭 ‘ 알’) 1개를 수수료 10%를 공제한 현금 4,500원으로 환전하여 주도록 하였다.
