Defendant shall be punished by a fine of KRW 700,000.

Where the defendant fails to pay the above fine, one hundred thousand won shall be one day.

Punishment of the crime

From January 1, 2014, the Defendant was appointed and worked as the president of the representative meeting of occupants of the apartment housing in Jeju City, and was dismissed by the president of the representative meeting of occupants on August 31, 2014.

Notwithstanding that the Defendant, as above, was notified of dismissal according to the result of residents' voting to the position of the chairperson of the resident representative meeting, and was not the chairperson of the C apartment occupant representative meeting, the Defendant prepared a draft document in the C apartment management office of Jeju-si around May 15, 2015 in the column of “Guidance on holding meetings of the occupancy election management committee”, “D, E, F, G, H members, and H members of the Election Management Committee” in the column of reception space, “1. The Defendant is going to hold a meeting of the election management committee as follows pursuant to Article 8(C apartment management committee meeting, etc.) of the Regulations of the Committee on the Management of Apartment Housing Management and to attend the election management committee meeting as follows in the column of reception space:

Place: The place was printed out with the statement "A" as the representative meeting room of occupants and the chairperson, and then the seal of the representative meeting of Jeju Industrial Complex C, which was held in advance by the chairperson of the representative meeting of occupants of the C apartment complex, was affixed.

Accordingly, the defendant, for the purpose of exercising, prepared a copy of a letter of guidance to hold a meeting of the committee for election management, which is a private document to prove facts, by gathering the qualification of the chairperson of the representative meeting of apartment occupants.

2. On May 15, 2015, the Defendant: (a) posted a notice of holding a committee for election management, which was prepared in C apartment as described in paragraph (1) around May 15, 2015; and (b) opened an event by inserting it in the mail of each Dong and number of houses corresponding to D, E, F, G, and H’s residence as members of the said apartment management committee, as if the said notice was duly established.
