Reasons
Punishment of the crime
1. The defendant is a person who is engaged in driving service of B observer passenger cars;
On July 25, 2014, at around 01:18, the Defendant driven the said vehicle while under the influence of alcohol of 0.142%, and the Defendant driven the said vehicle at a speed below the speed of the Si-high speed of 1,000, Seongdong-gu Seoul, Seongdong-gu, for the road of three-lanes in front of the Motor Vehicle Inspection Station, which is located in 634-46.
In such cases, a person engaged in driving of a motor vehicle has a duty of care to reduce speed and safely drive a motor vehicle by checking well the right and the right of the motor vehicle, and not drive a motor vehicle in a state where normal driving is difficult due to drinking.

As seen above, the Defendant suffered injury to the victim E by negligence in the course of performing duties, which is in need of a medical treatment for about a week, while driving a motor vehicle normally due to drinking, and suffered injury to the victim G (28 years of age) who is the passenger of the said damaged vehicle and the victim H (31 years of age) for approximately two weeks of medical treatment.
2. The Defendant violates the Road Traffic Act (driving) at the same time and time as the preceding paragraph, is under the influence of 0.142% of blood alcohol concentration from the Seoul Customshouse distance in Gangnam-gu Seoul Metropolitan Government to the site of the said accident at approximately 3km.
