가. 모욕 피고인은 2012. 10. 5. 00:52경부터 같은 날 00:53경까지 서울 영등포역 3층 전철개표구 앞에서 여객 안내 중인 피해자 C에게 다수의 직원들과 여객들이 듣고 있는 가운데 “야 씨팔년아, 전철이 왜 없어, 2시까지 운행한다고 했잖아, 개좆같은 년아, 뭘 쳐다보고 지랄이냐, 미친년아”라고 욕설을 하여 공연히 피해자 C를 모욕하였다.

B.
