1. The Defendant’s compulsory execution against the Plaintiff is based on the Seoul Central District Court’s decision on the amount of litigation cost fixed.

Comprehensively taking account of the purport of the entire arguments as to Gap evidence Nos. 1 and 2, it is recognized that the plaintiff deposited KRW 29,830,694 with the principal and interest of the litigation cost finalized in the Seoul Central District Court 2018KaMa1235 against the plaintiff in the case of an application for confirmation of the amount of litigation cost, which the defendant filed against the plaintiff, as the defendant, and that the plaintiff deposited KRW 29,830,694 with the principal and interest of the litigation cost finalized in the determination of the amount of litigation cost.

According to the above facts, since the plaintiff fully performs the obligation to bear the costs of lawsuit by the decision on the amount of the above costs of lawsuit, the execution based on the decision of the Seoul Central District Court 2018Kama1235 amount of the costs of lawsuit against the plaintiff shall be denied.

Therefore, the plaintiff's claim of this case is justified, and it is so decided as per Disposition.
