A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is the father and father of the victim B (16) and the victim C (15).

1. Assaults, injuries, child welfare violations against victims C (child abuse);

2016. 11. 4. 경 상해 및 학대행위 피고인은 2016. 11. 4. 01:30 경 삼척시 원덕읍 E 건물 103호 피고인의 집 안방에서, 술에 취하여 귀가한 피고인에게 피해자 C이 계속하여 쌍꺼풀 수술을 해 줄 것을 조르고, 피고인의 말에 말대답을 하는 것이 화가 난다는 이유로, 피해자에게 ‘ 씹할 년, 썅 년’ 이라는 등 큰소리로 욕설하여 피해자의 얼굴 및 머리 부위를 손바닥과 주먹으로 수회 때려 피해자에게 약 2 주간의 치료가 필요한 뇌진탕 등 상해를 가한 동시에 아동인 피해자의 신체에 손상을 주거나 신체의 건강 및 발달을 해치는 신체적 학대행위를 하였다.
