A defendant shall be punished by imprisonment for not less than three years and six months.

Punishment of the crime

[criminal power] On September 6, 2001, the Defendant was sentenced to a suspended sentence of ten months for larceny, etc. at the Seoul East Eastern District Court sentenced to imprisonment of ten months for larceny, etc. at the Suwon District Court on March 21, 2002, sentenced to imprisonment of ten years for larceny, etc. on February 8, 2007, and sentenced to one year for larceny in Sungnam branch of the Suwon District Court on January 14, 2009. On May 26, 201, the Defendant was sentenced to one year and six months for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny) at the Seoul Southern District Court Branch of the Incheon Southern District Court on September 21, 201, and completed the execution of the sentence at the Sungsung vocational training prison on September 21, 2011.

【Criminal Facts】

After release on September 21, 2011, the Defendant committed the following crimes with the intention to steals money and valuables and to purchase stolen-friendly credit cards, as they had been living in the street and living room after being released from Korea on September 21, 201, but the income was not certain but insufficient to meet living expenses due to lack of living expenses.

1. On July 17, 2012, the Defendant habitually committed a violation of the Aggravated Punishment, etc. of Specific Crimes (thief) around 17:00, the Defendant opened and intruded into the “Dental Research Institute” room located in Gangseo-gu Seoul Metropolitan Government, which had not closed the space of the victim E, and cited and stolen a bank containing a gift certificate of KRW 15,000 and an identification card, driver’s license, branch line, lot card, citizen card, Samsung Card, Samsung Card, Samsung Card, Mod Card, Mod Card, and Korean card.

In addition, from June 11, 2012 to September 8, 2012, the Defendant stolen the money and valuables of the victims by the same method 11 times in total, as shown in the attached Table 1, from around June 11, 2012.

2. Fraud and the Defendant in violation of the Specialized Credit Financial Business Act, around 18:20 on July 31, 2012, the victim G located in Gangseo-gu Seoul Metropolitan Government, for female arms at H department stores on the first floor “I” store operated by the victim G in Gangseo-gu, Seoul, in an amount equivalent to KRW 9,000 (3) at the market price.
