피고인은 2015. 1. 12. 14:00경 인천 서구 B에 있는 C 음식점내에서 술에 취한 채 음식값을 계산하지 않고 소란을 피우다가 신고를 받고 출동하여 사실관계를 파악하는 인천서부경찰서 D지구대 소속 경찰공무원인 피해자 E(29세)에게 종업원 F 등 수명이 듣는 가운데 “이런 씨발놈이 경찰이면 다야, 좆까 씨발놈아, 야 씨발놈아 좆까는 소리하고 있네, 죽여버릴까 보다, 이런 씨발놈들 검찰에 고발할 꺼야, 검찰총장도 내말이면 꼼짝 못해”라고 수차례 큰소리로 욕설하여 공연히 피해자를 모욕하였다.
