Reasons
Punishment of the crime
1. On August 20, 2013, the Defendant made a false statement to the victim C, the vice president of the victim C Co., Ltd. (hereinafter “victim Co., Ltd.”) at the construction site near Pyeongtaek-gun, Gyeonggi-do, D (hereinafter “victim Co., Ltd.”) that “The Defendant would give rise to a false statement to E, the vice president of the victim C Co., Ltd., who is the vice president of the victim Co., Ltd. However, the defendant did not have any authority in connection with F's work, and there was no intention or ability to allow the victim company to subcontract the interior work.
On August 21, 2013, the Defendant, by deceiving E, who is an employee of the victim company, received KRW 30 million from G to the account in the name of G from the victim company, and acquired it by deceiving KRW 30 million in cash from G on the same day.
2.
