A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On October 11, 2013, the Defendant was sentenced to two years of suspension of execution on August 19, 2013 by the Busan District Court for the crime of obstruction of performance of official duties, and the judgment became final and conclusive on October 19, 2013, and is still under suspension of execution.

1. 피고인은 2013. 7. 중순 22:00경 부산 동래구 B에 있는 C시장 내 피해자 D(여, 58세) 운영의 떡볶이노점상 앞에서 피해자에게 외상으로 순대 등 음식을 달라고 하였으나 피해자가 이를 거부하자 이에 화가나 피해자에게 “야이, 씨발년아, 장사하기 싫나, 죽을래”라는 등 큰소리로 욕설하면서 약 30분간 행패를 부리는 방법으로 위력으로 피해자의 노점 영업을 방해하였다.

2. On August 1, 2013, at around 21:00, the Defendant: (a) sold the fruit of the victim E (n, 63 years of age) in front of the overwork log store in operation of the said C market; (b) she saw the victim’s street store operation by force in a way that “Chewing baby, fruitly sold promptly, she is funerally, and she performs funeral services equally”; and (c) she embling the victim against it by taking advantage of the influence, such as placing the victim’s flash on the street, and placing the victim against it.

3. On August 31, 2013, the Defendant: (a) took care of the victim E (nives, 63 years of age) in the above C market; (b) took care of the victim, without any justifiable reason, such as “Phos, deads, and refusal to engage in funeral services,” and obstructed the victim’s street occupation by force in a way that 20 minutes of pedagoging the victim’s pedagogs in front of the victim E.; and (c) prevents the victim E from conducting funeral services.
