1. The plaintiffs' claims against the defendants are all dismissed.

2. The costs of lawsuit are assessed against the plaintiffs.

1. Basic facts

A. The Plaintiffs are equity holders holding 1/3 of each of the land and G, and I’s ground buildings (hereinafter “instant real estate”) in the Suwon-si District D, E, F, G, H, and G.

B. On April 24, 2015, Plaintiff A paid KRW 4,239,00,000 on or before the date of concluding a contract or within five days after the date of concluding a contract, and paid KRW 471,00,000, the remainder of KRW 4,239,000 on or after June 30, 2015 as designated by the buyer, and the sales contract was reserved to pay KRW 471,00,000 equivalent to 10% of the purchase price to Plaintiff A’s share in the instant real estate as KRW 4,710,00,000, among the instant real estate and the instant real estate. However, if Plaintiff A, a seller, has completed measures such as resolving the right existing in the instant real estate before the date of completion of the sale, the said contract was concluded.

C. As of May 15, 2015, Plaintiff B and C sold each share of Plaintiff B and C in the instant real estate as of May 18, 2015 at KRW 5,010,000,000, and the down payment of KRW 501,000,000, which is 10% of the purchase price, shall be paid within five days from the date of the contract or the contract date, and the balance of KRW 4,509,00,000 shall be paid on the date of the completion of the transaction designated by the buyer on or after June 30, 2015. However, the sales contract was reserved in order for Plaintiff B and C, the seller, to settle the restriction on rights existing in the instant real estate before the completion date of the sale and purchase, and to move to a lessee, etc. who occupies the instant real estate.

The Plaintiffs, as trustor, are the Defendants, at the office of the Urban Development Promotion Committee located in the Suwon-si K on June 29, 2015, as a purchaser.
