A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Around March 24, 2016, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (or the injury) and the Road Traffic Act (or the measures subsequent to an accident) (or the Defendant), while under the influence of alcohol of 05:35% during blood transfusion, 0.148%, driven the C Costaex vehicle and proceeded along two-lanes with the 5-lane road near the transformation distance in Ulsan-gu.

A person engaged in driving of a motor vehicle shall not drive a motor vehicle while under the influence of alcohol, and since it is an intersection through which a large number of vehicles pass, he/she has a duty of care to prevent accidents by safely driving in accordance with traffic signals in advance.

Nevertheless, the Defendant neglected this and received as the front part of the vehicle driving by the Defendant, due to the negligence of entering the intersection in contravention of the vehicle stop signal, the victim D (50 aged) who enters the intersection from the new tri-distance flood of the vehicle in accordance with the vehicle running signals to the intersection.

Ultimately, the Defendant, by negligence in the above occupational negligence, sustained injury to the victim, such as salt, tensions, etc. of a trend requiring treatment for about two weeks, and escaped without immediately stopping the vehicle and providing relief to the injured party, even though it was damaged to the extent to cause the vehicle scrapping.

When Defendant 1 was under the influence of alcohol level of 0.148% during the blood transfusion of the above day, Defendant 2 driven the above Lone Star vehicle at a section of about 3 km to the road adjacent to the intersection of the eros shooting distance in the same Gu through the place of accident from the Do near the sound market in Ulsan-gu to the place of accident in paragraph 1.
