Defendant

The appeal is dismissed.

1. The summary of the grounds for appeal (e.g., imprisonment with labor for up to six months) of the original judgment is too unreasonable.

2. The following circumstances can be considered: (a) the Defendant reflects his/her mistake and repents in depth; (b) the amount of damage is a relatively small amount; and (c) the theft goods have been returned to the victim.

However, the crime of this case is deemed to have been committed in a way that the defendant held a correction device for the game owned by the victim and stolen money by using the force chain that the defendant had operated a string machine, and the nature of the crime is not good. The defendant appears to have been partially inside the river for the crime of this case. The defendant was planned to commit the crime of this case, such as writing her mother at the time of the crime and her face with her face, and the defendant had a majority of the criminal tools, such as pent, nifers, and rus at the time of the crime of this case, and the defendant seems to have planned to commit the additional crime, and the defendant has a majority of criminal records of the same kind

In this context, the recommended sentence according to the sentencing guidelines set by the Supreme Court Sentencing Committee is from June to June, 1 year to June, theft against general property, theft against general property, 1 type, special person (no person), basic area, and the scope of recommended punishment (one to six months of imprisonment). In addition, considering the character and conduct of Defendant, environment, motive and circumstance of the instant crime, means and consequence of the instant crime, circumstances before and after the instant crime, etc., it is not recognized that the sentence of the court below is too unreasonable.

3. The defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the defendant's appeal is groundless. It is so decided as per Disposition.
