Defendant
A shall be punished by imprisonment with prison labor for ten months, and imprisonment with prison labor for six months.
However, for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On August 14, 2014, Defendant A was sentenced to two years of imprisonment with prison labor for night-time structure intrusion larceny, etc. at the Goyang Branch of the District Court, Defendant A completed the execution of the said sentence on May 10, 2016.
No person shall transfer or acquire any access medium unless otherwise expressly provided for in other Acts in using and managing the access medium.
Nevertheless, around 13:50 on September 21, 2016, the Defendant acquired five physical cards, which are access media, on three occasions from September 12, 2016 to September 21, 2016, such as receiving one copy of the No. 3 card (E) in front of the exit No. 90 new village No. 1, Seoul Mapo-gu, 90, under the direction of a person without his name, and receiving one copy of the No. 3 (E) from a person with no name, from September 12, 2016.
2. In using and managing an access medium, Defendant B shall not keep, deliver or distribute the access medium while receiving, demanding or promising the consideration, unless otherwise specifically provided for in other Acts;
A. On September 20, 2016, the Defendant received KRW 30,000 or KRW 40,00 from a person in a name-free will, around September 14:30, 2016, on the road located in the Nam-gu, Incheon Metropolitan City, the Defendant received 30,000 or KRW 40,00 from a person in a name-free will, according to the direction of a person in a name-free will, received KS a e-mail card (L) from KR, and continued to receive 17:30 on the same day from N around 17:30, the Defendant received e-mail card (O) from N in addition, and received e-mail, a accessible medium.
