A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for five years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant, despite the fact that he is not a handler of narcotics, handled the Mepta and marijuana as follows:

1. Import and delivery of marijuana;

A. On July 24, 2014, the Defendant: (a) ordered D to receive postal items containing 60g of marijuana, which were sent by D using international mail from D around Daegu-gu, Daegu-gu, 306 Dong-dong 120, F to the Defendant’s house located in D around July 24, 2014; and (b) received the said marijuana from D around July 2014, at the Defendant’s house located in Ansan-si, Seoul-si.

Accordingly, the defendant imported marijuana.

B. On July 2014, the Defendant issued 10g of marijuana to D in return for the receipt of the said marijuana on a vehicle parked near I located in Ansan-si at the end of the end of 21:00 and around H.

Accordingly, the defendant delivered marijuana free of charge.

2. Import of synthetic marijuana;

A. On August 17, 2016, the Defendant sent 265,000 won to the non-person who is the operator of the Internet site J using the remittance system, the remittance system, and around August 25, 2016, the Defendant received three grams of synthetic marijuana (one sphac 9 “Sphac 99”) including the merptian ingredients sent by the above non-person who was the above-mentioned person through international mail in the U.S. at the above Defendant’s home.

Accordingly, the defendant imported Mept ambamins.

B. On August 29, 2016, the Defendant sent 265,000 won to the non-resident, who is the website operator as described in the above paragraph (a) using the wastic system, and received three grams of synthetic marijuana (one name hereinafter referred to as “Spha 99”) including the Meptian component sent by the non-resident via international mail at the Defendant’s home on September 2016, 2016 to the Defendant’s house.

Accordingly, the defendant imported Mept ambamins.

3. On August 25, 2016, the Defendant of synthetic marijuana smoking: (a) containing 0.05g of synthetic marijuana purchased, as described in the foregoing 2-A., in tobacco at D’s dwelling room room 505 located in Nam-gu, Daegu-si, Daegu-si; and (b) containing 0.05g of tobacco purchased.
