A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

However, although the defendant did not have a mobile phone to sell to the victim, he/she received 70,000 won from the victim's new bank account in around 14:13 of the same day.

『2014고단568』 피고인은 2013. 6. 11. 14:00경 스마트폰 어플 E에 피해자 G가 “지샥 시계를 구매합니다”라고 게시한 글을 보고 피해자에게 연락하여, “7만원을 송금하면 시계를 보내주겠다”라고 거짓말을 하였다.

그러나 사실은 피고인은 지샥 시계를 가지고 있지 않았으므로 피해자로부터 돈을 받더라도 시계를 보내줄 의사나 능력이 없었다.

『2014고단947』 피고인은 2013. 6. 9.경 불상의 장소에서 중고물품 거래하는 스마트폰 어플리케이션인 ‘E’ 게시판에 “쥐샥(G-SHOCK) 시계를 판매합니다.“라는 글을 게재하여 이를 보고 카카오톡 메세지를 보낸 피해자 I(15세)에게 “7만원을 송금해주면 택배로 시계를 보내주겠다.”라고 하였다.
