A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a person who is in a marital relationship with the victim C (math, 25 years of age).

1. 상해 피고인은 2012. 12. 11. 08:00경 대전 대덕구 D아파트 109동 302호 피고인의 주거지 내에서, 피해자와 화장실 사용문제로 말다툼을 하던 중, 피해자가 "병신 같은 새끼야, 빨리 나와."라고 욕을 하자, 이에 격분하여 주먹으로 피해자의 배를 8회 가량 때리고, 피해자를 바닥에 쓰러뜨린 후 무릎으로 피해자의 양쪽 옆구리를 4회 차고, 계속하여 양손으로 피해자의 머리채를 잡아 머리카락을 뜯고, 피해자의 머리를 잡아 흔들면서 방바닥에 수회 찧고, 손바닥으로 피해자의 뺨을 10여회 때리는 등 폭행하여 피해자에게 약 15일간의 치료가 필요한 턱의 염좌 및 긴장 등의 상해를 가하였다.
