A defendant shall be punished by imprisonment for three years.

Punishment of the crime

On April 4, 2005, the Defendant was sentenced to imprisonment for eight months with prison labor for larceny, etc. at the Daegu District Court on June 9, 2005; imprisonment for six months with prison labor for larceny, etc. at the Daegu District Court on November 9, 2005; imprisonment for eight months with prison labor for larceny, etc. at the Daegu District Court on November 9, 2006; imprisonment for one year and six months with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny) at the Daegu District Court on November 13, 2007; imprisonment for one year and six months at the Daegu District Court on July 16, 2009; and on June 9, 2011, on April 5, 2014, the Defendant was sentenced to imprisonment with prison labor for three years for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes.

1. Around 01:00 on April 17, 2014, the Defendant habitually stolen the victims’ property at least six times in total, as indicated in the annexed crime list, by opening a car door owned by the victim D, which was parked on the road in front of Daegu Northern-gu, Daegu-gu, Seoul-gu, and opening the car door, KRW 13,000 in cash owned by the victim, and KRW 13,00 in the market price in which Samsung Card 1 was entered.

2. Attempted fraud, fraud, or violation of the Specialized Credit Finance Business Act;

A. On April 18, 2014, the Defendant purchased boarding passes equivalent to KRW 322,200 from 5 boarding tickets at the 5th boarding ticket issuance machine located in Daegu Northern-gu, Daegu Northern-gu, Daegu-gu, on April 18, 2014, and attempted to settle the purchase with a stolen Samsung Card, as stated in the attached Table No. 1, but the Defendant attempted to do so with the wind, the approval of which is refused due to an error in password.

B. On April 18, 2014, at around 05:48, the Defendant purchased one of the dynamics from the G of the victim’s operation in Daegu North-gu, Daegu North-gu, which was located in the name of the victim, and presented the stolen Samsung Card as if it were one’s credit card, and then had an employee in arrears settle KRW 157,50,00.
