① 성명불상자(일명 ‘AF’, 이하 ‘AF’이라고 함)는 중국 청도(靑島)시 지역에서 보이스피싱 등 작업장을 운영하는 총책이고, ② 피고인 AB, 피고인 AC은 AF의 지시를 받아 ‘알바몬’(www.albamon.com)과 같은 인터넷 구인구직 사이트에 직원을 구한다는 취지의 허위 글을 게시하고, 그 글을 본 구직자들로부터 인적사항, 계좌정보 등을 취득하여, 보이스피싱 등 범행에 쓸 이른바 ‘대포계좌’ 용도로 ‘AF’에게 제공하고 인출금의 10% 상당을 분배받기로 하고, ③ 피고인 P은 피고인 AB(일명 ‘AG 실장’)의 지시를 받아 위 구직자들로부터 지하철역 등에서 인적사항, 계좌정보 등이 적힌 서류들을 건네받고 지하철역 보관함에 넣어두는 이른바 ‘픽업책’ 역할을 맡아 시간당 9천원 상당을 지급받기로 하고, ④ 피고인 A은 성명불상자(일명 ‘AH’)의 지시를 받아 지하철역 보관함에서 위 구직자들의 인적사항, 계좌정보 등이 적힌 서류들을 꺼내어 은행에서 편취금을 인출하는 이른바 ‘인출책’ 역할을 맡아 인출금의 5~6% 상당을 분배받기로 순차 공모하였다.
