A defendant shall be punished by imprisonment for six months and by a fine of thirty thousand won.

When the defendant does not pay the above fine.

Punishment of the crime

1. Any person who intends to convert a mountainous district into a mountainous district shall obtain permission from the Administrator of the Korea Forest Service, etc. according to classification of the types, areas, etc. of mountainous districts prescribed by Presidential Decree;

Nevertheless, on July 2013, the Defendant did not obtain permission for conversion of mountainous districts, and installed electric facilities with a shield of 923 square meters in smuggling C, D, a quasi-permanent conservation mountainous district, and diverted the mountainous district without permission for the purpose of Otopping.

2. Violation of the National Land Planning and Utilization Act and the Farmland Act;

(a) A person who intends to engage in development activities in an agricultural promotion area shall obtain permission for development activities, and obtain permission for diversion of farmland in order to divert farmland in an agricultural promotion area, and shall not engage in land-use activities not directly related to agricultural production or improvement of farmland in an agricultural promotion area;

Nevertheless, the Defendant, without obtaining permission for development or farmland diversion from July 2013 to September 2013, and from April 11, 2014 to April 201, 2014, the Defendant used 191m2, F field E, 124m2, G field, 1,319m2, H field, 85m2, and 329m2,818m2, among the 57m2,000 square meters in an I field, in aggregate of 329m2,00m2,00 in a land-to-land and 329m2,000m2, in an agricultural and forest area and an agricultural promotion area, and installed two buildings in the office and warehouse to conduct development activities without permission, and used it for the purpose of use without permission, and used the farmland for agricultural improvement or farmland in the agricultural promotion area.

(b) Any person who intends to engage in development activities outside an agricultural promotion area shall obtain permission for development activities, and obtain permission for diversion of farmland to divert farmland;

Nevertheless, the Defendant did not obtain permission for development and farmland diversion, and from around July 2013 to September 2013, and from around April 11, 2014.
