1. The judgment of the first instance court, including the Plaintiff’s claim extended by this court, is modified as follows.

1. Facts of recognition;

A. The Defendant operates a restaurant with the trade name of “D” in the Young-gu Busan Metropolitan City (hereinafter “instant restaurant”), and the Plaintiff was employed in the said restaurant and was in charge of the main support work.

B. The Plaintiff retired on August 14, 2017 while serving on May 11, 2017 (hereinafter “the first service period”), and retired on November 5, 2017, and retired on July 27, 2018.

The fixed wage, working hours, working days, etc. by working period of the plaintiff shall be as specified in the following table:

The fixed-term working hours: From May 11, 2017 to August 14, 2017, the fixed-term working hours: 1,80,000 won (the first working period) 1,80,000 won to August 14, 2017; 09:30-21:30-6, to April 14, 2017; 1: From October 5, 2017 to April 14, 2018 (the second working period): From October 5, 2017 to December 14, 2017; 2: 1,80.00 won from October 5, 2017 to December 14, 2018; 2: 1,0000 won from October 15, 2017 to October 14, 2018; 3:0-1,000 won from October 14, 2018.

(d) The minimum wage per hour under the Minimum Wage Act is KRW 6,470, and KRW 7,530,00 in 2017.

2. The parties' assertion

A. The Plaintiff asserted that the Plaintiff was not paid KRW 2,016,986 from the minimum wage calculated on the 11-hour daily working hours, on the grounds that only one-hour working hours were given during the first working period. As such, the Plaintiff was not paid KRW 2,133,565 from the minimum wage calculated on the 8-hour working hours per day.

Therefore, the defendant's wages that were not paid to the plaintiff.
