A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. No person shall borrow a construction business registration certificate or construction business registration pocket book from another constructor or perform construction works using his/her name or trade name, and any kindergarten with a total floor area of not more than 495§³ or any building other than residential buildings with a total floor area of not more than 495§³ exceeding 495§³ shall be constructed by the constructor;

On May 2015, the Defendant: (a) borrowed relevant documents, such as a construction business registration certificate, etc. in the name of the Co., Ltd. in the name of the Co., Ltd. necessary for reporting the commencement of construction; (b) filed a report on the commencement of construction in the name of the Co., Ltd. around May 29, 2015; and (c) constructed a kindergarten (the owner: D et al.) with the total floor area of 397.39 square meters in the same place at the same time.

B. On October 8, 2015, the Defendant: (a) lent to the person under whose name the Defendant was not a constructor in Yong-si, Young-si; and (b) lent relevant documents, such as a construction business registration certificate in the name of F Co., Ltd. required for reporting the commencement of construction; (c) reported the commencement of construction in the name of F Co., Ltd. around October 8, 2015; and (d) constructed a childcare center of the total floor area of 1,192.95 square meters in the same place (a building owner: G et 1).

2. Any person who intends to operate a construction business shall register the national land with the Minister of Construction and Transportation by industry as prescribed by the Presidential Decree;

From October 2014 to October 2015, the Defendant operated a construction office with the trade name “I” in Sungnam-si, and did not register with the Minister of Construction and Transportation of the national land.
