The judgment of the court below is reversed.

The defendant shall be innocent.

1. The summary of the grounds for appeal (misunderstanding of the facts or misapprehension of the legal principles) is not established since it cannot be recognized that the defendant's "purpose to satisfy the sexual desire" can not be recognized in light of the circumstance in which the defendant sent the victim the same letters as the facts charged in this case.

2. Determination

(a) No person prosecuted shall allow any words, sounds, letters, pictures, images, or other things that may cause a sense of sexual humiliation or aversion through telephone, mail, computer, or other means of communication, with intent to arouse or satisfy his/her own or another person's sexual desire;

C. The Defendant sent the victim a text message stating “I am am f-day in Kim,” and “I am am f-day in Kim.”

Accordingly, the Defendant sent to the other party a letter that may cause sexual humiliation or aversion through the communication media with a view to meeting his own sexual desire.

B. The lower court’s judgment, based on the circumstances that can be recognized by the evidence as indicated in its reasoning, is sexual humiliations against the Defendant.
