A defendant shall be punished by imprisonment with prison labor for not more than ten months.

2. 2020. 5. 24.경 범행 피고인은 2020. 5. 24. 23:00경 제1항 기재 피고인의 주거지에서 피해자가 SNS 인스타그램 'D'계정에 피해자의 얼굴을 촬영한 사진을 업로드 한 글을 보고 피고인의 성적 욕망을 만족시킬 목적으로 피고인의 ‘F’ 계정을 이용하여 “나 걍 너 보면서 딸치는 거”라는 댓글을 작성하고, 피고인의 발기된 성기를 잡고 있는 장면을 촬영한 사진을 인스타그램 개인메시지로 피해자에게 전송하였다.
