1. Defendant Korea’s share of 23.1/102.9 square meters in Dongdaemun-gu Seoul Metropolitan Government D 102.9 square meters, respectively, to the Plaintiffs.
Reasons
1. Facts of recognition;
A. A. On October 1, 1957, Dongdaemun-gu Seoul Ega 9,223 was land owned by the Defendant Republic of Korea. The above land was divided into a replotting disposition, division, etc., the Dongdaemun-gu Seoul Metropolitan Government D-102.9 square meters (hereinafter “instant land”). The subdivision registration was completed on February 25, 2003.
(At the time of subdivision registration, the share of Defendant Korea was changed to 46.2/102.9 and the share of Defendant C was changed to 56.7/102.9, respectively, due to the confirmation of subdivision under the Act on Special Cases Concerning the Partition of Co-Owned Land, as to the share of 1830.880/923 as to the share of the land of this case, and as to the share of 27.31/923 as to the share of 1830.880/923.
On the other hand, the building was built on the ground of Dongdaemun-gu Seoul, Dongdaemun-gu, 9,223, and the owners of each building possessed some of the above land as the site of the building.
C. Accordingly, from November 15, 1957, the defendant Republic of Korea sold a specific part corresponding to the occupied area of the building on the above land to each owner, and the registration was completed at the ratio corresponding to the sold area among the entire land area. However, on December 10, 1962, the defendant Republic of Korea purchased 27.31 square meters from the above land and completed the registration of ownership transfer for the portion of 27.31/923 square meters from the above land, and completed the registration of ownership transfer for G on March 8, 1983. The defendant C purchased it from G on June 10, 1983 and completed the registration of ownership transfer on June 11, 1983.
On June 10, 1983, Defendant C purchased it from G on June 11, 1983, and completed the registration of ownership transfer on June 11, 1983, with respect to a house located on the ground of the instant land (Seoul, Dongdaemun-gu D Ground No. 5 and 31.21mm2, hereinafter “instant house”).
No certified copy of the Gu register shall be verified with respect to any change in the relationship of rights under the previous register because it has not been submitted.
