[Defendant A] The defendant shall be punished by imprisonment for a year and six months.

However, the above punishment shall be imposed for three years from the date of the final judgment.

Punishment of the crime

1. The sole criminal conduct of Defendant A;

A. From November 26, 2008 to December 9, 2008, the Defendant registered the Defendant himself as a false hospitalized patient in the form of 14 days from the Jwon located in Gwangju-gu, Seo-gu as “the following softa”.

However, in fact, the defendant did not have symptoms to the extent that does not interfere with daily life, or was insignificant, and there was no fact of being hospitalized and treated.

Nevertheless, on February 10, 2009, the Defendant pretended to have received hospital treatment as normal, and claimed insurance money from the victim interesting country, fire, marine insurance company, etc. on February 10, 2009. The Defendant received KRW 560,000 from the said company on March 16, 2009.

In addition, the Defendant, as stated in the attached Table “A”, was hospitalized for 157 days in total from November 26, 2008 to June 25, 2012, as well as 12 insurance companies from January 6, 2009 to October 16, 2012, and acquired a total of 37,364,316 won as insurance money from 12 insurance companies.

B. Around May 2009, the Defendant used the K insurance contract, who was known to the general public, asked K to purchase insurance for the performance of L’s mother who works as an insurance solicitor, and to identify the insurance premium if he/she is the head of the Tong who has subscribed to the insurance and paid the insurance premium.” At the same time, K allowed the insurance premium to be used for the payment of the insurance premium, etc., and K opened the agricultural bank account (M) in the name of K to the Defendant.

Accordingly, from June 30, 2009 to July 14, 2009, the Defendant had K register as an in-type hospitalized patient for 15 days from the Otype department located in the Seo-gu in Gwangju, Seo-gu, Gwangju as “the base of salt and tensions of the Helle”. Since then, the Defendant had Q Hospital located in Gwangju, Seo-gu P register a female in his name in the form of 11 days from July 23, 2009 to August 2, 2009 as an in-form hospitalized patient, and around that time, from around that time to February 2, 2011, as stated in attached Table 2 to 2, 2011, instead of K.
