A defendant shall be punished by imprisonment for not less than two months.

Punishment of the crime

1. On July 22, 2016, the Defendant made a false statement that “Around July 22, 2016, the Defendant would pay KRW 6.5 million including interest 5 million on August 11, 2016, and actively assist the victim’s business, including KRW 500,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000 won.”

However, at the time of fact, the Defendant had no intention or ability to make changes in the name of the Defendant, who was in bad credit standing and did not have any property or income in the name of the Defendant, and has no obligation of KRW 100,000,000 or more.

The Defendant, as such, by deceiving the victim, received 6 million won from the victim to the account in the name of Korea bank designated by the Defendant on the same day.

2. On July 29, 2016, the Defendant made a false statement by phone call to the above victim, stating that “F Cooperation Bonds need to be transferred, and KRW 1850,000 should be transferred.”

However, at the time of fact, the defendant had no means of self-reliance as above, and even if he received the money from the injured party, he was thought to use it for the repayment of his personal debt, but did not have the intention or ability to use it as the F

As such, the Defendant, by deceiving the victim, was transferred KRW 1850,00 to the account in the name of G bank designated by the Defendant on the same day from the victim.

3. On August 17, 2016, the Defendant phoneed to the above victim and used KRW 1,00,000,000 to use the F Litcar purchasing department. If the Defendant additionally lent KRW 1,00,000 to B, he/she would allow the victim to sell the vehicle owned by the victim to the F Litcar side, and will receive the brokerage commission and pay all the money borrowed during that period.
