A defendant shall be punished by imprisonment for two years.
Reasons
Punishment of the crime
[criminal record] The Defendant was sentenced to two years of imprisonment with prison labor for a crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes in the Cheongju District Court’s Assistance on November 9, 2006; on April 1, 2012, the same court was sentenced to imprisonment with prison labor for six months by larceny, etc.; on June 28, 2013, the same court was sentenced to two years of imprisonment with prison labor for a crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes; and on October 8, 2015, the Defendant was sentenced to two years of imprisonment with prison labor for the same crime of violation of the same Act.
[Criminal facts]
1. Habitual theft;
A. On April 18, 2016, at around 18:30, the Defendant entered a restaurant of “D” in the name of “D” and took meals together with the victim E, the Defendant found out of the above restaurant, the victim’s share of approximately 50,000 won in cash, and the market price of the victim’s share of the Nonghyup Credit Card, etc., located outside the restaurant, and stolen the Defendant’s share of the 200,000 won in the front part of the clothes.
B. On May 8, 2016, around 03:12, the Defendant: (a) entered “H dan” operated by the victim G in 03:0,000, and performed drinking as a customer; (b) discovered a wall having a cash of KRW 15,00,00 in the vicinity of the said main place calculation unit; and (c) stolen the victim’s market price in a way that the victim’s possession with a credit card of the National Bank, etc. was found to have a face value of KRW 200,000,000; and (d) used the gap in which the victim’s surveillance was neglected
Accordingly, the defendant habitually stolen the victims' property two times.
2. On May 8, 2016, the Defendant violated the Act on Financial Business Specializing in Fraud and Credit Business enters the trade name’s main points of “K,” operated by the Victim J, Inc., at Jeju-si on May 8, 2016, and ordered drinking and drinking alcohol, and thereafter, the Defendant stolen the Defendant as described in Article 1(b).
