Punishment of the crime

1. 특정범죄가중처벌등에관한법률위반(위험운전치사상) 및 도로교통법위반(음주운전), 도로교통법위반 피고인은 2012. 11. 9. 22:45경 업무로써 혈중알콜농도 0.262%의 술에 취하여 정상적인 운전이 곤란한 상태에서 B STEED 600CC 오토바이를 운전하여 구미시 인의동에 있는 투다리호프 앞 편도 1차로를 따라 구평동 방면에서 인의초등학교 방면으로 진행하던 중, 음주상태에서 전방주시의무를 태만히 한 채 운전한 업무상 과실로 전방의 우측 도로가에 주차되어 있던 피해자 C 소유인 D 포르테쿱 승용차 좌측 뒤 범퍼 부분을 위 오토바이 앞부분으로 충격하고, 계속하여 중앙선을 넘어가 반대편 차로 전방에 정차하고 있던 피해자 E(22세) 운전의 F 아베오 승용차 좌측 앞 범퍼 부분을 위 오토바이 앞부분으로 충격하였다.

결국 피고인은 위와 같은 업무상 과실로 피해자 E에게 약 2주간의 치료가 필요한 경추부 및 요추부의 다발성 타박상 등을 입게 함과 동시에 위 포르테쿱 승용차를 수리비 486,702원 상당이 들 정도로, 피해자 G 소유의 위 아베오 승용차를 수리비 2,269,318원 상당이 들 정도로 각 손괴하였다.
