1. The Plaintiff:
A. Defendant J points out of the real estate listed in the separate sheet, each of which is indicated in the annexed sheet No. 1, 2, 5, 6, and 1.
Reasons
1. Facts of recognition;
A. The Plaintiff is an association established to implement a housing reconstruction project whose project area covers 33,693.8 square meters in the Dongjak-gu Seoul Metropolitan Government, and was granted authorization to establish the association on August 12, 2010 by the head of Dongjak-gu Seoul Metropolitan Government, the authorization to implement the project on December 7, 201, and the authorization to implement the management and disposal plan on May 30, 201, and the said authorization to implement the management and disposal plan was publicly notified on June 12, 2014.
In addition, the Plaintiff held a general meeting on September 1, 2014 to resolve the case of approval for the amendment of the management and disposition plan, and obtained the authorization for the amendment of the management and disposition plan on October 17, 2014. This was publicly announced on October 23, 2014.
B. Defendant G and H are the Plaintiff’s members of the real estate indicated in the separate sheet (hereinafter “instant real estate”), who are the owner of the real estate indicated in the separate sheet (hereinafter “instant real estate”), and possessed and used the portion of 39.696 square meters in the ship (D) connected with each point of 8,9,10,11, and 8 of the instant real estate in sequence.
C. From Defendant G and H, Defendant J, Defendant J, in sequence with each of the points indicated in the annexed drawings 1, 2, 5, 6, and 121.68 square meters and 121.68 square meters on board among the instant real estate; Defendant C, in sequence, connects each point of (b) the indication of the same drawings 2, 3, 4, 5, and 2; Defendant D’s portion of 72.76 square meters in the ship; Defendant D connects each point of (c) the same drawings 7,8,11, 12, 13, and 7; Defendant D’s portion of 49.587 square meters in sequence; Defendant E’s portion of 19,16, 17, 18, and 199 square meters in order with each other; Defendant C’s portion of 48 square meters in the ship; Defendant C’s portion of 148 square meters in possession and 154,164,196,1-16,4.
