1. The Defendants shall jointly and severally pay to the Plaintiff KRW 65,849,00 and the interest rate from February 26, 2017 to the day of full payment.

The plaintiff is a company that engages in the business of distributing food, daily necessities, etc., and the defendant A is a person who has operated a miscellaneous store in Mayang-gu, Gyeyang-gu.

The Plaintiff supplied Myeon, rice tea, mosium, etc. from around December 2012 to March 2013 at the place of business operated by Defendant A.

A around May 10, 2013, Defendant A prepared and delivered to the Plaintiff a letter of payment that the Plaintiff would pay KRW 65,849,000 payable to the Plaintiff by June 17, 2013, and Defendant B jointly and severally guaranteed Defendant A’s obligation to the Plaintiff.

According to the above facts, the Defendants are jointly and severally liable to pay to the Plaintiff the unpaid amount of KRW 65,849,000 and damages for delay calculated at the rate of 15% per annum from February 26, 2017 (the day following the delivery of the complaint as requested by the Plaintiff after the payment date) to the day of full payment (the day following the delivery of the complaint).
