Defendant shall be punished by a fine of KRW 2,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

No one shall distribute, post, spread, screen or run an advertisement, letter of personnel management, poster, photograph, document, drawing, printed matter, recording or video tape and others similar thereto, which contain the contents of supporting, recommending or opposing a political party or candidate (including a person intending to become a candidate), or the name of a political party or candidate, with the aim of influencing the election from 180 days before the election day to the election day.

1. On April 12, 2018, at around 11:20, the Defendant, using computers located in D offices located in C, sent text messages to “E”, which are Internet text dispatch agencies, by means of automatic broadcast communication, against F political parties members and election district residents, 10,978, as described in attached Table 1, stating that the Defendant complained of H’s support, which is a candidate for the presidential election of the political party of G Gun election F party, was sent by means of automatic broadcast communication.

2. At around 13:01 on April 13, 2018, the Defendant connected the said D Office to the said “E”, and then sent a text message to F Party Members and 27,944 people in the constituency by means of automatic broadcast communications, as described in attached Table 2 of the List of Crimes, to the F Party Members and 27,94 people in the constituency.

As a result, the defendant distributed documents, drawings, etc. including the support of the person who wishes to be a candidate in order to influence the election.
