Defendant shall be punished by a fine of KRW 1,000,000.
When the defendant does not pay the above fine, 100,000 won.
Reasons
Punishment of the crime
1. On January 19, 2015, the Defendant embezzled 4 copies of credit cards, etc. (slick cards, Hyundai MM cards, Memarket cards, and home-fluoring cards) lost by C outside the exit of Jongno-gu Seoul Metropolitan Government No. 90 Seodaemun-dong 90, and embezzled them without following necessary procedures, such as returning them to the victim, even though he/she acquired four copies of credit cards, etc. (slick cards, HyundaiM cards, Memarket cards, and home-fluorial cards).
2. Violation of the Specialized Credit Financial Business Act, fraud and fraud;
A. On January 19, 2015, the Defendant purchased tobacco at the F convenience store operated by the victim E of Seodaemun-gu Seoul, Seodaemun-gu, Seoul, the Defendant settled KRW 41,000 and acquired the said tobacco by presenting the slot card in the above name C as if the Defendant was a credit card.
B. On January 19, 2015, around 13:57, the Defendant purchased 9 A at the first convenience store operated by the victim H located in Seodaemun-gu Seoul Metropolitan Government, Seodaemun-gu, and then paid 63,000 won by presenting the card under the above name C as if he was the Defendant’s credit card, to an employee with no name, and acquired it by fraud.
C. On January 19, 2015, at around 15:06, the Defendant issued an order, such as a lush charge at a Lcafeteria operated by the victim K located in Seodaemun-gu Seoul, Seodaemun-gu, Seoul, to pay KRW 30,00,00, by presenting the card acquired as stated in paragraph (1), as if the Defendant was a credit card holder, to an employee in the name of the Defendant, and obtained the above food and acquired it by fraud.
On January 19, 2015, the Defendant: (a) purchased coffee, etc. at the Ncaco shop operated by the non-spiker of the victim’s name in Seodaemun-gu Seoul, Seodaemun-gu, Seoul; (b) tried to pay the amount equivalent to KRW 24,00,00, by presenting the card obtained as stated in paragraph (1) to an employee as if he was a credit card holder; (c) however, the card approval was refused, and the intention was not achieved.
