Defendants shall be punished by imprisonment for six months.

However, for two years from the date this judgment became final and conclusive, each of the above defendants is against the defendants.

Punishment of the crime

Defendant

On September 7, 2020, A was sentenced to 8 months of imprisonment with prison labor for special larceny at the Seoul Central District Court, and the above judgment was finalized on September 15, 202. On September 7, 2020, Defendant B was sentenced to 2 years of suspended execution for 6 months of imprisonment with prison labor at the Seoul Central District Court for special larceny and became final and conclusive on the 15th of the same month.

1. Defendant A

A. On July 16, 2020, around 02:42, the Defendant: (a) obtained a copy of KB national credit card (F) and Samsung Credit Card (G) that the victim E lost on the road near the D convenience store located in Gwanak-gu in Seoul Special Metropolitan City; (b) but did not take necessary procedures, such as returning it to the victim; and (c) took on his/her own thought that he/she had it.

Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

B. On July 16, 2020, the Defendant purchased tobacco at the convenience store in the operation of the victim H in Gwanak-gu in Seoul Special Metropolitan City, on July 16, 2020, the Defendant settled the payment by presenting the KB-national credit card under the name of E, such as the statement in paragraph 1 (a), as if he was his card, and was issued 2 A tobacco equivalent to 9,000 won in total at the market price from the employees of the above convenience store in name. 2) On July 16, 2020, the Defendant purchased food and drink at the convenience store in the operation of the victim JJ in Gwanak-gu in Seoul Special Metropolitan City on July 16, 2020, after purchasing the food and drink at the convenience store in the operation of the victim J in Seoul Special Metropolitan City, the Defendant received the payment by presenting the Samsung credit card acquired, as stated in paragraph 1 (a), as one’s own card, and then delivery of the above convenience store in name and drinking water equivalent to 35,000 won.

3. On July 16, 2020, the Defendant purchased tobacco at the convenience point of the victim M management in Gwanak-gu in Seoul Special Metropolitan City L on July 16, 2020, and paid the price by presenting the Samsung Credit Card in the name of the E, as described in paragraph 1(a), as if it were his own card, and then, is on the part of the name.
