1. The Defendant’s KRW 167,00,000 and the Plaintiff’s annual rate of KRW 5% from December 21, 2018 to January 9, 2020.

1. Basic facts

A. 1) The Plaintiff is a company established for the purpose of obtaining orders for improvement projects and remodeling as a proxy, establishing a rearrangement project association, and managing and disposal agency. 2) The promotion committee for the establishment of a housing association for the extension and remodeling of B apartment (hereinafter “promotion committee”) is the promotion committee for the establishment of housing association in order to carry on the remodeling project of multi-family housing in the Songpa-gu Seoul Metropolitan Government and B apartment zone located in D (hereinafter “instant project”).

3) The Defendant completed the inaugural general meeting on May 11, 2019, and received authorization from the head of Songpa-gu Seoul Metropolitan Government to establish a housing association on August 1, 2019, and comprehensively succeeds to the rights and obligations of the promotion committee. B. The Plaintiff entering into the instant service contract with the promotion committee on June 30, 2017 and the instant service contract (hereinafter “instant service contract”).

Article 2 (Status between Parties)

1. The promotion committee shall entrust the plaintiff with the affairs of remodeling agency related to Article 3, and the plaintiff shall faithfully perform the affairs of services entrusted by the promotion committee.

4. As to this contract, the committee of promoters at the inaugural general meeting of the committee of promoters shall obtain ratifications from the members of the committee of promoters, and the officers and members of the committee of promoters or the committee of promoters shall have the effect of this contract even after the establishment of a new model housing association.

[Scope of Business] Article 3 [Scope of Business] The plaintiff shall perform, provide advice and support for the following affairs related to the business of this case with the approval of the promotion committee, and prepare and process documents related to the business of this case shall be governed by the Housing Act, the articles of association (laws), etc.
