Reasons
Punishment of the crime
[criminal power] On April 21, 2010, the Defendant was sentenced to a suspended sentence of two years in the year and February due to a violation of the Act on the Regulation of Conducting Fund-Raising Business without Permission at Suwon District Court.
【Criminal Facts】
1. Around June 27, 2011, the Defendant made a false statement to the effect that the victim C would pay 120,000 won to the victim C a mobile phone store located adjacent to the E Hospital located adjacent to the Nam-gu Incheon Metropolitan City, Nam-gu, and distributed 120,000 won to the victim C at intervals of five days, according to the investment amount.

Accordingly, the defendant was given property by deceiving the victim.
2. On December 201, the Defendant made a false statement to the effect that “The Defendant would return KRW 8,400,000,000,000,000 that was first lent to the said victim C at a place where the location cannot be known, at a place where the location cannot be known.”
However, even if the victim receives money from the victim, there was no intention or ability to return the borrowed money by running a restaurant business for swine machine.
The Defendant received KRW 4 million in total from the victim on December 19, 201 and KRW 2 million on December 22, 201.
Accordingly, the defendant was given property by deceiving the victim.
3.
