1. The defendant shall be punished by imprisonment for two years;

2. The defendant shall be ordered to complete a sexual assault treatment program for 80 hours.

Punishment of the crime

1. 피고인은 2012. 3. 중순경 시흥시 신천동에 있는 상호를 알 수 없는 노래방에서 동거녀 C의 조카인 피해자 D(여, 17세) 및 C의 딸인 E(피해자의 사촌 동생) 등과 함께 노래를 부르던 중, E가 자리를 비운 틈을 이용하여 양손으로 피해자의 볼을 꽉 쥐면서 입을 벌린 다음 혀로 피해자의 입술을 핥아, 아동청소년인 피해자를 강제로 추행하였다.

2. 피고인은 2012. 3. 중순경 시흥시 F아파트 가동 511호에서 위 피해자 D가 화장대에 앉아 화장을 하고 있는 것을 보고, 뒤에서 피해자를 양손으로 껴안으면서 가슴을 만지고, 양손으로 볼을 꽉 쥐면서 입을 벌린 다음 혀로 피해자의 입술을 핥아, 아동청소년인 피해자를 강제로 추행하였다.

All other circumstances indicated in the records, such as the Defendant’s age, occupation, family relationship and social relationship, benefits and preventive effect expected by an order of disclosure or notification to the Defendant, and disadvantages and side effects, etc., as well as the fact that the Defendant has no record of punishment for a sexual crime under the proviso to Article 38 (1) and the proviso to Article 38-2 (1) of the former Act on the Protection of Children and Juveniles against Sexual Abuse, the Defendant living together with the victim for a considerable period of time, and the victim was a relative to the victim.
