1. The Defendants are listed in the attached Table 2, among the real estate listed in the attached Table 1, to the Plaintiff (Appointed Party) and the Selection AT.
Reasons
1. Facts of recognition;
A. On July 8, 1978, the building was newly constructed on the 157m2m2, AV large 372m2, AW large 439m2 on the ground of the Busan Nam-gu, Busan. On September 8, 1978, the registration of divided ownership was completed on the part of AX (attached Form 1; hereinafter “the instant partitioned building”).
B. The aggregate building ledger for the instant partitioned building was registered with 21 persons including the Plaintiff (Appointed Party) and the Appointed AT (hereinafter “Plaintiffs”), Defendant B, C, D, and E’s deceased AY, Defendant G, etc.
C. On November 21, 1991, the Plaintiffs purchased each ownership share of the instant partitioned building from the said 19 persons registered as owners of the instant partitioned building except the Plaintiffs.
The Plaintiffs filed the instant lawsuit to complete the registration of ownership transfer for the partitioned building itself.
(E) The right to use the site, right to a site, etc. on the partitioned building of this case seems to be subject to separate procedures.
On the other hand, some of the above 21 persons are deceased and have succeeded to all the rights and obligations by inheritance.
The respective shares of the Defendants are as shown in the attached Table 2.
