Reasons

1. Basic facts

A. The Plaintiff is a market reconstruction and improvement project association established to promote A’s reconstruction and improvement project in Seongbuk-gu Seoul and 192 lots of land, and completed the registration of incorporation on July 31, 2003 pursuant to the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents after obtaining authorization from the head of Seongbuk-gu Seoul office on November 9, 1998.

B. On August 19, 2003, the Plaintiff obtained permission for the construction of a G main apartment (hereinafter “instant apartment”) which is an aggregate building of 189 square meters and 3 underground floors above land and 25 stories above ground in Seongbuk-gu, Seoul, and the G main apartment (hereinafter “instant apartment”). From September 3, 2004, the Plaintiff began to complete the registration of ownership transfer on each of the above lands in sequence, and commenced the construction of the said apartment building on June 1, 2005.

C. On July 11, 2005, the Plaintiff entered into a sales contract with H to supply the instant apartment I (hereinafter “instant building”) with the sale price of KRW 324 million (hereinafter “instant sales contract”). The main contents of the said sales contract are as follows.
