A Imprisonment with prison labor for a year and six months, Defendant C, E, F, G, H, and I shall be punished by imprisonment with prison labor for each of ten months.
Reasons
Punishment of the crime
1. Criminal records;
A. On November 4, 2015, the Defendant was sentenced by the Seoul Northern District Court to a two-year suspended sentence of imprisonment for the purpose of obstruction of performance of official duties, etc., and the judgment became final and conclusive on November 12, 2015, and is currently under the suspended sentence.
On November 27, 2015, the Defendant lodged an appeal after having been sentenced to one year and six months of suspension of execution for a violation of the Punishment of Violences, etc. Act at the Seoul Western District Court on November 27, 2015, and on June 2, 2016, the Defendant was sentenced to two years of suspension of one year of imprisonment with prison labor for the same court on June 2, 2016 (the name of a crime recognized as a special injury): Provided, That the Defendant dismissed the appeal on July 27, 2016,
B. On May 6, 2015, Defendant H was sentenced to a suspended sentence of one year and four months of imprisonment for fraud in Hongsung Branch of the Daejeon District Court for the purpose of fraud, and the said judgment becomes final and conclusive on May 14, 2015, and is currently under the suspended sentence.
2. Criminal facts;
A. Defendant A, B, F, H, E, andO’s co-offenders: (a) around March 2013, Defendant A, who was aware of in the course of working as a restaurant delivery center, was engaged in gambling with the victim P, who is a restaurant operator, and called “bagod”.
The term "batter" means a betting event only once when gambling participants go on a board and distribute a total of four cards to all, and thereafter, they have an opportunity to alter a card using a word "supper", and the card may be altered both from one to four. When the card is altered, a person who has an opportunity for betting and does not engage in betting once he/she alters the card. This three times of the card exchange is an gambling method in which a person with low numbers of betting differs from the form of betting and open a plaque by opening the card.
Defendant
