A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

[Attachment] On November 7, 2013, the Defendant was sentenced to imprisonment with prison labor for at least six months in the Seosan Branch of the Daejeon District Court for night building intrusion larceny, and two years of suspension of the execution of imprisonment with prison labor for at least six months, and on November 15, 2013, the Defendant is currently under suspension of the execution of imprisonment with prison labor.

【Criminal Facts】

1. The crime committed on October 7, 2013;

A. On October 7, 2013, at around 13:20 on October 7, 2013, the Defendant: (a) opened an unspecified gate and intruded into the victim’s house with a view to cutting away the object from the body of the victim D(n) located in Jinjin-si C.

B. A thief: (a) the Defendant: (b) taken off the passbook in the above temporary border or in the above D’s multi-use room; (c) confirmed the passwords from the joint page on which the account password was written; and (d) withdrawn KRW 3,00,000,000 in cash owned by the victim by means of inserting the above passbook and inputting the passwords into the cash withdrawal machine managed by the Docheon Agricultural Bank, Nonghyup, Inc., in the above passbook and in the Myeoncheon-si, Myeoncheon-si.

2. The crime committed on October 13, 2013;

A. At around 10:00 on October 13, 2013, the Defendant: (a) opened a gate that was not corrected for the purpose of stealing the said victim’s house; and (b) entered the victim’s house and intrudes into the victim’s house.

B. A thief: (a) the Defendant, within the above temporary border and the above house multi-use room, taken out the passbook in the name of the Defendant, taken out the passbook (Account Number E) from October 7, 2013; (b) confirmed the password on the pages with the passwords entered; and (c) withdrawn KRW 2,460,000 in cash owned by the victim by means of inserting the passbook and inputting the passwords in the cash withdrawal machine managed by the Agricultural Cooperative in the Busan National Agricultural Cooperative, Inc., which was located in the area of the above passbook and Seosan-si, and entered the passwords.

3. Crimes committed on October 28, 2013;

A. On October 28, 2013, the Defendant who intrudes upon his/her residence was not corrected for the purpose of cutting away the object from the body of the said victim D at around 12:20.
