A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
"2013 Highest 2015"
1. Night-time theft of buildings;
A. At around 18:00 on January 2, 2013, the Defendant: (a) opened an open door with which locking devices are installed and intruded into the victim D office located on the third floor rooftop of the building located in Ulsan-dong-gu, Ulsan-gu, Seoul; and (b) used and stolen the passbook owned by the victim and the passbook Nos. 10 (Account Number E) located on the west heading.
B. On January 18, 2013, at around 21:50, the Defendant came to place in the above paragraph (a) above, and then came to a locked door, put the entrance door in a locked state, cancelled the correction device, put the correction device in a cresh, put the correction device into an intrusion, and put the agricultural bank passbook (Account Number G) owned by the victim F.
2. Larceny;
A. On January 2, 2013, around 18:17, the Defendant: (a) stored the stolen passbook in cash withdrawal machines at the Seogsan-dong, Ulsan-dong, Ulsan-dong, 113-136 No. 113-136, the Defendant: (b) saved it in cash withdrawal machines; (c) withdrawn 50,000 won in cash; and (d) withdrawn 50,000 won in cash.
B. On January 6, 2013, at the place indicated in the above paragraph (a) around 23:11, the Defendant: (a) stored a stolen passbook in a cash withdrawal machine; (b) entered a password in a passbook; and (c) withdrawn KRW 300,000 in cash, and stolen the cash of the Victim Nonghyup Bank.
C. On January 18, 2013, from around 21:58 to 22:02, the Defendant collected stolen bankbooks as described in the foregoing paragraph 1-B, and entered the passwords stated in front of the passbook into the cash withdrawal machine installed in the same place, and then withdrawn KRW 3.29 million in total on four occasions, and stolen the cash of the Victim Nonghyup Bank.
