Defendant shall be punished by a fine of KRW 700,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

[Presumption Facts] The Defendant was elected and held as the president of the G Agriculture Cooperatives (hereinafter “G”) around March 2006, and was re-appointed at the simultaneous election of the president of the association on March 11, 2015, and is currently the president of the G association.

[Criminal facts]

1. The head of an agricultural cooperative that violated the Agricultural Cooperative Act, on November 201, 2013, shall not make a contribution while in office, and where he/she provides money or goods for congratulations or condolences at the expense of a cooperative, he/she shall specify the expenses of the cooperative in the name of the cooperative, and where he/she provides such money or goods at the expense of the cooperative, he/she shall be deemed to make a contribution in the name of the cooperative

Nevertheless, on November 8, 2013, the Defendant stated “A” as his/her name on the bags of a 100,000 won in cash (50,000 won 2) which is the expenses of the association, at the G president’s office located in H, and ordered G employees I to deliver the said bags to K’s members as a substitute for the marriage congratulatory, which is the son of the J. On November 17, 2013, and I provided the said J with the said bags at the above J’s residence located in L around November 17, 200.

Accordingly, the defendant made a contribution to J, an electoral member.

2. The head of an association, such as a public organization, etc., shall not make a contribution while in office, and where money and valuables are provided for congratulations or condolences at the expense of the association for congratulations or condolences, he/she shall specify the expenses of the association in the name of the association, and where the name of the representative of the association is disclosed or it is presumed that such act is made, such act shall be deemed a contribution act.

Nevertheless, on December 13, 2014, the Defendant directly provided a stable bag containing KRW 200,000 (50,000 won) in cash for the purpose of the marriage congratulatory with M, while the Defendant, in G materials and warehouses located in H around 12:20 on December 13, 2014, referred to as “a large number of gold bags” to the members M, and directly provided a stable bag containing KRW 200,000 (50,000 won) for the purpose of the marriage congratulatory with M.

Accordingly, the defendant is an elector.
