A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Around 22:52 on October 27, 2014, the Defendant: (a) boarded a taxi (D) operated by the victim C (the age of 59) on the front side of the hub in the hot spring area located in Busan East-gu, Busan; (b) was placed in the linkage market located in the Sosan-dong; and (c) was re-determined to E after arriving in the Interlock market.
Therefore, at around 23:10 on the same day, the victim was driving with the above domicile, and he expressed his bath to "a sprinke any sprinke anywhere" while boarding the above taxi on the roads near the Busan Doksan-dong 8-dong, Busan Doksan, and 2 times the victim's right shoulder.
Accordingly, the Defendant assaulted a driver in operation.
2.
