A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

[Criminal Power] On January 14, 2005, the Defendant was sentenced to 15 years of imprisonment with prison labor for murder at the Seoul Eastern District Court, and was released on August 14, 2018 during the execution of the sentence and passed on October 1, 2019.

【Criminal Facts】

At around 21:00 on November 23, 2019, the Defendant: (a) expressed his desire to “C convenience store” operated by the victim I (the 54 years of age) located in Guro-gu Seoul Metropolitan Government; (b) on September 6, 2019, the victim D (the 25 years of age), who is his/her father, committed assault to the Defendant, and reported to the police, that he/she was sentenced to a fine of KRW 4 million due to the said D’s failure to reach an agreement on the case, and (c) expressed his/her desire to “the 4 million won of the fine, which would incur KRW 4 million of the fine, shall be rounded off,” and (d) expressed his/her desire to “the victim I, as the victim would appear in I, threatened the victim I from that time to December 9, 2019, as stated in the attached list of crimes, and threatened the victims at least five times in total.

Accordingly, the defendant threatened victims for the purpose of retaliation against criminal complaints, etc. in connection with his criminal case investigation or trial.
