Defendant shall be punished by a fine of KRW 5,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The defendant is a building owner who implements construction of new agricultural warehouse facilities in the name of the defendant in the old Si B, and manages the safety and health management of workers employed at a construction site, and the victim C(57) is a worker who has worked at a construction site as a miscellaneous unit for construction.

As the business owner of the above workplace, the defendant was engaged in the management of the safety and health of workers.

The business owner shall install a reinforced with sufficient strengths to take protective measures, such as safety railing, fences, vertical fall telescopes, covers, etc., at places where workers might fall down, as the end or opening of the work board and passage, and where the business owner works in places where material objects fall, fall off, fall, or are at risk of fall, he/she shall have the safety cap and safety belt worn.

Nevertheless, on May 12, 2017, the Defendant, on the 1st roof of a warehouse facility at a construction site around 14:35 on the same roof, caused the victim C to die with a sufficient strength to take protective measures, such as safety railing, despite the risk of falling by causing the victim C to wear a safety cap and safety belt, by negligence not requiring the victim to wear a safety cap and safety belt, and caused the victim to die with a concrete floor located below about 5 meters in height without recognizing the end of the roof while on duty, at around 18:38 on the same day on the same day.

In the end, the Defendant, while working, has to take necessary measures to prevent the danger at a place where a worker is at the risk of falling, caused the death of the victim due to negligence in the course of business not performing the necessary measures.
