Reasons
Details of the disposition
On November 18, 1991, the Plaintiff was first appointed as a local administrative secretary, and served in the Defense Acquisition Program Administration from January 27, 2016 to February 18, 2018. From February 19, 2018 to February 19, 201, the Plaintiff is a person working in the Defense Acquisition Program Administration C Team.
On August 17, 2018, the Central Disciplinary Committee decided to take the following disciplinary actions against the Plaintiff for one month of suspension from office and one time of disciplinary surcharge (the target amount: 20,000 won) against the Plaintiff’s misconduct (hereinafter “instant misconduct”). Accordingly, on September 4, 2018, the Defendant imposed one month of suspension from office and one time disciplinary surcharge on the Plaintiff’s violation of Articles 56 (Duty of Good Faith) and 63 (Duty of Maintenance of Dignity) of the State Public Officials Act.
From January 27, 2016 to February 18, 2018, the Plaintiff served in the Category B D Team. ① From February 2016 to December 4, 2016, the Plaintiff took a spambling at E Co., Ltd. (hereinafter “E”)’s employee restaurant over three occasions from November 2017 to January 2018. ② At the time of a business trip at the Felto, from April 2017 to July 2017, the Plaintiff received KRW 50,000 from the Felto to the settlement place of accommodation, the Plaintiff received KRW 5,000 from the Felto to receive KRW 5,00,00 from the settlement place of accommodation, and received KRW 50,000 from the Furto to receive KRW 50,000 from the Furtoto’s office from time to time without performing his/her duty-related duties-related duties-related duties-related duties-related duties-related duties-related duties-related duties-related duties-related duties-related duties-related duties-related duties-related duties-related duties-related employees.
The Plaintiff filed a request for review on the above disposition, and the appeals review committee changed the disposition of suspension from office on December 14, 2018 to the disposition of reduction of salary three months, but made a decision to dismiss the request for disciplinary surcharge.
