Reasons
Punishment of the crime
[criminal power] On April 30, 2015, the Defendant was sentenced to a suspended sentence of one year and six months in violation of the Punishment of Violences, etc. Act (a collective, deadly weapons, etc.) at the Busan District Court, and on May 8, 2015, the said judgment became final and conclusive and is currently in the grace period. On August 19, 2016, the Defendant appealed two years from imprisonment with prison labor at the Jeonju District Court for a violation of the Act on the Control of Narcotics, etc. and is currently pending in the appellate trial, and is not a person handling narcotics.

1. Sale;
A. On January 19, 2016, the Defendant: (a) transferred KRW 500,000 to the account of community credit cooperatives designated by the Defendant and sold approximately 1.5g gramphones to D, upon request for delivery of psychotropic drugs-related psychotropic drugs-related Mediphones (hereinafter “diphones”); and (b) sold approximately 1.5g Mephones to D.
B. On April 16, 2016, around 16:00, the Defendant: (a) parked in GMW car located around F located in the Dong-gu, Busan; (b) 1.2 million won from H; and (c) sold 5 grams of opon to H.
C. On April 12, 2016, the Defendant: (a) transferred KRW 318,00 from D to the account of community credit cooperatives (K) in the name of the Defendant on the front of J Park in Busan-gu, Busan-do; (b) transferred KRW 318,00 to the account of community credit cooperatives (K) in the name of the Defendant; and (c) sold approximately two grams of phiphones to D through a taxi article in the name of the Defendant.
On April 2016, the Defendant: (a) around 01:00, around 01:30, 300,000 won from H in the Defendant’s residence under the Dong-gu Busan Metropolitan City L; and (b) sold 0.7 gal-phones to H.
E. On April 25, 2016, at around 16:00, the Defendant: (a) laid down KRW 1070,000 from H in the Defendant’s residence; and (b) sold approximately 3.2 grams of phiphones to H.
2. Crimes committed through attempted sale;
A. On February 2016, the Defendant was driving the Defendant, who stopped on the N in the Southern-gu M in Busan, but was parked on the O in front of the N in Busan.
