A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

1. 특수공무집행방해 피고인은 2014. 7. 27. 02:50경 안산시 단원구 D건물 4층에 있는 ‘E주점’ 103호에서 친구 F과 술을 마시던 중 여자도우미들이 동석하지 않고 잠시 문을 열고 안을 들여다본 뒤 그냥 간 것에 불만을 품고 ‘도우미 불법영업을 한다.’고 112신고를 하여 현장에 출동한 안산단원경찰서 G지구대 소속 경사 H과 순경 I이 피고인에게 신고내용을 확인하고자 질문하자 “씨발, 짭새 새끼들. 너네가 서장이냐 , 대가리 숙일래 더럽게 고압적이다.” 라고 말하면서 위 경찰관들을 향해 테이블에 놓인 스카치블루 양주병 1개를 집어 던지고, 다시 처리 절차를 설명하는 위 경찰관들을 향해 테이블에 놓인 맥주병 1개를 들고 휘둘렀다.

Accordingly, the defendant carried dangerous objects and interfered with the legitimate execution of duties by police officers on criminal investigation and prevention.

2. 모욕 피고인은 같은 일시, 장소에서 피해자 H과 피해자 I에게 노래방 종업원이 듣고 있는 가운데 “이 좆같은 씨발 짭새 새끼들, 이런 개새끼, 짭새가 나 얄밉지, 씹새끼야. 아니꼬 와 , 씨발 짭새 새끼들.” 등의 욕설을 약 40분간 하여 공연히 피해자들을 각각 모욕하였다.
